1. Sponsor. This sweepstakes consists of various sporting events as listed on the “Events” page of this website (each a “Sweepstakes” and collectively, the “Sweepstakes”) and is sponsored by Collect 2 Win, LLC (“Sponsor”), 16810 West Kenton Drive, Suite 210, Huntersville, NC 28078.
2. Entry Period. Each Sweepstakes will commence and end at the dates and times listed with the applicable event (each a “Sweepstakes Period”). All entries must be received by the end of the applicable Sweepstakes Period. A separate page on the website will list current and future events.
3. Sweepstakes Overview. In this Sweepstakes, Eligible Entries (as defined below) will be awarded Sweepstakes Entry Numbers (as defined below). The Sweepstakes Entry Numbers that match the official winner of the designated event of the applicable Sweepstakes will win a Prize (as defined below), subject to the other terms and conditions set forth in these Official Rules. By participating in this Sweepstakes, persons submitting entries (“Participants”) agree to be bound by these Official Rules and the interpretations of these Official Rules by the Sponsor, which are final in all matters relating to the Sweepstakes.
4. Eligibility. Each Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia who have reached the age of majority in their state of residence at the time of entry. In most states this will be age 18; however, in some states the age of majority is older than age 18, and it is the responsibility of each Participant to determine the age of majority in his or her particular state. By participating in a Sweepstakes, each Participant represents to the Sponsor that he or she has reached the age of majority in his or her state of residence. Employees and the immediate families (parent, child, sibling and spouse) of employees of the Sponsor and each of its respective parents, affiliates, subsidiaries, agents or representatives’ employees, dealers or retailers, and advertising or promotion agencies are ineligible to enter or win any of the Sweepstakes.
5. How to Enter. Participants may enter a Sweepstakes in one of two ways:
(a) Anyone that purchases merchandise from http://www.collect2win.com/ (the “Site”) will be automatically entered provided the purchase is verified and approved; and
(b) Anyone that submits the following information typed or printed in block letters on a 3 inch by 5 inch index card: full name, full and complete street address, city and state, zip code, telephone number including the area code, email address, date of birth (MM/DD/YYYY), a self defined user ID code (consisting of more than four but less than eight letters and/or numbers), a self defined password (consisting of more than four but less than eight letters and/or numbers) and the Sweepstakes in which the Participant chooses to be entered. The index card must be mailed in an envelope via the United States Postal Service, first-class postage prepaid, to Sponsor’s address listed in Paragraph 1 above, and be received before the close of the applicable Sweepstakes Period. A mail-in entry will be treated in the same manner as an online entry received by the purchase of merchandise from the Site. Mail-in entries will be limited to one household address per Sweepstakes and must be accompanied with a return self addressed stamped envelope. The return address must be the same address outlined on the index card. Illegible, late, damaged or postage-due mail-in entries will not be accepted.
Entries complying with the above are “Eligible Entries.” Sponsor reserves the right and at its sole discretion may reject any entry for failure to fully comply with these Official Rules.
6. How to Play. For online Eligible Entries, Participants will access the order form to purchase merchandise by clicking on either the “Start” icon or on the “Put Yourself in the Event” text located on the Site; and then follow the instructions to order merchandise. Before placing an order, the Site will define the specific Sweepstakes by disclosing the number of entries that will be awarded with each item ordered and which designated event is to be included in that particular Sweepstakes. At the completion of each approved order, the Site will award as many entry numbers as was defined to be awarded with each item purchased. All sales are final and no refunds will be allowed. The entry numbers will be awarded from a pool of numbers associated with the players, teams, cars, etc. known to be competing in the sporting event associated with that particular Sweepstakes (“Sweepstakes Entry Numbers”). All Sweepstakes Entry Numbers will be awarded from the pool of available numbers, until the pool has been exhausted, at which time the same pool of available numbers will again be awarded until exhausted, and so on until the earlier of the ordering of merchandise stops or the Sweepstakes deadline date and time occurs. This process of awarding Sweepstakes Entry Numbers from the pool of available number will result in there being approximately the same quantity of each Sweepstakes Entry Number being awarded.
Each mail-in Eligible Entry will be awarded one of the Sweepstakes Entry Numbers. All Sweepstakes Entry Numbers will be awarded using the same methodology described above. A mail-in Eligible Entry shall be listed on the Site under the User ID and password provided on the 3 inch by 5 inch index card described above. A Participant’s email address, name and Sweepstakes Entry Numbers may be accessed on the Site by using the Participant’s personal User ID and password.
7. Selection of Sweepstakes Winners. If a Sweepstakes Entry Number is the same number that is determined to be the final official winner of the actual designated event, then the Participant has a sweepstakes winning entry. If none of the Sweepstakes Entry Numbers match the number determined to be the final official winner of the designated event, then the Sweepstakes Entry Number matching the first runner up of the designated event will be the Sweepstakes winning entry. If none of the Sweepstakes Entry Numbers match the first runner up, then the Sweepstakes Entry Number matching the second runner up of the designated event will be the winning entry and so on, until a winning entry is found.
8. Odds. The quantity of eligible numbers in the pool determines the odds of winning a prize.
9. Sweepstakes Prizes. The amount of the prize for each Sweepstakes (the “Prize”) will be predetermined and listed with the corresponding event. Sweepstakes winners will receive the prize via mail at the mailing address for online Eligible Entries provided at the Site at the time of purchase and for mail-in Eligible Entries at the mailing address provided on the 3 inch by 5 inch index card. No alternative or change of mailing addresses will be accepted by the Sponsor. Sweepstakes winning prizes which are undeliverable after one attempt by the Sponsor shall be void and the winnings shall be contributed to a charity of the Sponsor’s choice. No transfer of the Prize is permitted by Winner(s). No substitution of Prizes is permitted. Limit one (1) Prize per individual.
All Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied. SPONSOR DOES NOT MAKE, AND HEREBY EXPRESSLY DISCLAIMS, ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZES DELIVERED IN THE SWEEPSTAKES INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
10. Winner Notification. Winner(s) will be notified by email, using the information in Sponsor’s records, within approximately fourteen (14) days after the date on which a designated event winner has been determined by the Sponsor. Acceptance of a Prize constitutes permission to use a winner’s name, and/or likeness for purposes of advertising and promotion without further compensation as permitted by law. Winner(s) will be required to sign and return an affidavit or declaration of eligibility, liability release, and, where lawful, publicity consent within fourteen (14) days following attempted notification. Failure to comply within fourteen (14) days, any prize notification returned as undeliverable, or if a winner declines his or her Prize may result in disqualification. The Sponsor is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify the winner(s).
All materials and information submitted by a Participant become the property of the Sponsor and will not be returned. If the identity of a Participant is disputed, the authorized credit card holder submitted at the time of the approved purchase/entry will be deemed the Participant, with the same address as the billing address. Each winner may be required to provide the Sponsor with proof that he or she is the authorized credit card holder associated with a winning online entry or the person identified on the 3 x 5 inch card for a winning mail-in entry.
11. General Terms. The Sponsor reserves the right, in its sole discretion, to adjust the dates or cancel this promotion for any reason including, but not limited to a change in the schedule of designated events, technical failure, physical injury to participants of the designated events, disqualification of participants of a designated event, and/or unauthorized intervention. The Sponsor, its parent company, affiliates, subsidiaries, directors, officers, employees, advertising, promotion, and fulfillment agencies, and legal advisors (collectively, the “Sponsor Entities”), are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, or unintelligible entries; (ii) telephone, electronic, hardware or software problem, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmission; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the Prize, or acceptance, possession, or use of the Prize, or from participation in the Sweepstakes or (vi) any printing or typographical errors in any materials associated with the Sweepstakes. The Sponsor reserves the right in its sole discretion to change these Official Rules, upon proper legal notice if required by law, or suspend or cancel the Sweepstakes at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper play of the Sweepstakes and award Prizes from all online and mail-in Eligible Entries received prior to action taken.
12. Tax Liability. The reporting and payment of any federal, state, and local tax liabilities incurred by any winner(s) as a result of this Sweepstakes are the sole responsibility of the winner(s). The winner(s) will hold Sponsor harmless from liability for failure to timely report and/or pay such taxes.
13. General Release. By entering the Sweepstakes, each Participant agrees to release and hold harmless the Sponsor and the Sponsor Entities from any liability whatsoever, and waives any and all causes of action, for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Sweepstakes or acceptance, possession, or use of any Prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Participant further agrees that all rights under Section 1542 of the California Civil Code, and any similar law of any state or territory of the United States, are hereby expressly waived. That section, in pertinent part, provides:
A general release does not extend to claims which the Creditor does not know or suspect to exist in his favor at the time of the executing of the release, which if known by him must materially affect his settlement with the debtor.
By entering, Participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules. By entering, Participants consent to the jurisdiction and venue of the federal, state and local courts located in Charlotte, North Carolina. EACH PARTICIPANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THESE COURTS.
14. Conduct. The Sponsor reserves the right in its sole discretion to disqualify any individual it suspects or finds: (i) to have used a software–generated, robotic, programmed, script, macro or other automated online or text message entry; (ii) to have tampered with the entry process or the operation of this Sweepstakes; (iii) to be acting in violation of these Official Rules; (iv) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (v) to have provided inaccurate information on any legal documents submitted in connection with this Sweepstakes. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
15. Request for the Names of the Winner(s) and Official Rules; Questions about the Sweepstakes. The Official Rules will be posted at the Site throughout the Sweepstakes. A Winners List and a copy of these Official Rules may be obtained at the Site or by sending a self-addressed stamped envelope (please specify “Official Rules” or “Winners” or both on the envelope) to: Collect 2 Win, LLC, 16810 West Kenton Drive, Suite 210, Huntersville, NC 28078; within sixty (60) days of the applicable Sweepstakes deadline date. Residents of Vermont may omit return postage. Questions regarding the Sweepstakes may be sent to Collect 2 Win, LLC, 16810 West Kenton Drive, Suite 210, Huntersville, N.C. 28078.
16. Use of Data. Sponsor will be collecting personal data about Participants online, in accordance with Sponsor’s privacy policies. Please review the Sponsor’s Privacy Policy at the Site. By participating in the Sweepstakes, Particpants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.
